Rules for Drugs and Drug Paraphernalia

What is considered Drug?

Drugs can be a medicine or other substance which has a physiological effect when ingested or otherwise introduced into the body. Drugs can be natural or synthetic and can be used to diagnose, mitigate, treat, or prevent a disease or relieve discomfort. Legal drugs (approved by the FDA) are different from illegal drugs (controlled substances).

“Drug paraphernalia” is a term to refer to any equipment, product, or addition that is intended for making, using, or masking drugs. Drugs such as marijuanacocaine, and heroin, are related to a wide range of paraphernalia. 

The only products permitted after approval, for distribution and sale are Over the Counter (OTC)

Rules: 

  • OTC Products:
    • The OTC product must state the quantity of the prescription drug in the container. 
    • The OTC product must be in the original manufacturer’s packaging.
    • The OTC must be new and unused.
    • The package must show the identifying codes by the manufacturer or distributor, such as matrix codes, lot numbers, or serial numbers.
    • Must be approved by the FDA as OTC medicine (FDA-OTC Regulations)
    • OTC products must be labeled in the English language and must have the following information:
  • Specify the name medicine
      • The “Drug Facts” panel
      • The active ingredient(s)
      • The use or purpose(s) of the drug
      • Warnings
      • Directions of Use
    • Inactive Ingredients
  • OTC must not require a physician’s prescription or medical supervision for the use
  • OTC cannot be recalled drugs
  • OTC cannot have any substance prohibited by the DEA (Drug Enforcement Administration)
  • OTC cannot have untrue marketing claims as advised by the FDA: Health Fraud Scams
  • OTC drugs cannot be adulterated.
  • OTC drugs cannot be misnamed or misbranded
  • Your listing must not contain any drugs with ingredients like:
    • Hemp: full-spectrum hemp oil, Rich hemp oil
    • Any controlled substance according to the Schedule of Controlled Substances (https://www.deadiversion.usdoj.gov/21cfr/cfr/2108cfrt.htm )
    • Coca or derivative
    • Hallucinogenic mushrooms
    • Poppy pods, poppy straw, and poppy straw concentrate; Listings for poppy seeds that make certain claims, including listings for poppy seeds that reference poppy tea, poppy seeds that are “unwashed,” poppy seeds that reference alkaloid content, and poppy seeds that reference opium are prohibited.
    • Lugol’s Solution (aqueous iodine) with more than 2.2% iodine cannot be listed.
    • Drugs cannot be part of the list of illegal drugs stated by the Drug Enforcement Administration (example but not limited: Salvia Divinorum, Kratom, Jimson Weed)
  • There must be a statement of the limit of pill count per buyer.
  • Listings for products claiming to have psychoactive or hallucinogenic effects are prohibited, including “designer drugs” such as methoxetamine.
  • Listings for products claiming to produce an effect like an anabolic steroid, such as “Legal Steroids,” are prohibited.
  • Listings for products claiming to imitate the effects of a controlled substance, prescription drug, or substance identified by the FDA as an unapproved new drug or tainted supplement are prohibited, including synthetic cannabinoids and bath salts.
  •  
    • Homeopathic teething products are prohibited.
    • Injectable drugs are prohibited.
    • Male enhancement supplements with the brand name Rhino are prohibited from sale.

It is prohibited to sell prescribed drugs, illegal drugs, or any other substance that requires a doctor’s prescription, or it is considered illegal by the local or international governmental authorities, not approved by the FDA.

Animal Prescription and OTC for Pets

 Medication for Vet use and classified as OTC by the FDA: Animal & Veterinary can be listed on Zona Shoppers.

  • Medications not accepted on Zona Shoppers are those:
  • Medications with broken packaging or re-packed,
  • Not approved by the FDA as OTC, 
  • Flea & Heartworm products which need a doctor’s prescription, 
  • Injectable substances (of any kind).

Paraphernalia Associated with Drugs and Controlled Substances Prohibited on Zona Shoppers

    3. Listings for products that reference a product’s use with illegal drugs are prohibited.
    4. Listings for drug products that contain more than 2.2% iodine are prohibited, even those in an aqueous solution.
